What does it take to keep talent in Portugal? João Taborda da Gama reflects on the fiscal and legal dimensions of return in new RTP1 documentary.
Every year, thousands of young, highly educated Portuguese professionals leave the country in search of better opportunities abroad. In Diploma de Saída, a new documentary produced by the Fundação Francisco Manuel dos Santos and aired on RTP1 on 26 and 27 June, investigates this ongoing pattern of emigration — and asks what it will take to reverse it.
João Taborda da Gama, partner at Gama Glória, is among the experts featured. A tax and public law specialist with deep experience at the intersection of law and policy, João brings legal and constitutional nuances to the economic thrust of this debate.
“If we think that the cause of the talent drain is economic,” he says, “then the only meaningful response must also be economic. There’s no magic here. If someone leaves to earn more money, we can’t offer him a better beach and expect him to stay – he’s had a beach his whole life, and he’s going to work somewhere it rains more.”
João points to recent fiscal instruments — including the Programa Regressar and the evolving IRS Jovem regime — as practical, if cautious, efforts to shift the economic equation. “These are programs that raise the median income of qualified young people,” he notes. “They seem like the right measures in this sense, although somewhat timid and with some legal questions in their implementation.”
One such question is constitutional: how do we justify fiscal benefits for some taxpayers over others? “Whenever there is a fiscal advantage, there’s a question of equality,” João explains. “The constitutional judge must assess whether this inequality is compensated by another constitutional value. In the present context, I believe it is. If the same policy were extended for 20 or 30 years, I would question its legitimacy.”

As João concludes, the question of return cannot be reduced to tax incentives alone. “Portugal will always be a small economy, and therefore in the pool of attractiveness to talent, it’s competing with the global world and an open Europe. It’s not just for a fiscal discount that people go or come. It’s about whether they have a home, whether they can raise children in dignified conditions, whether maternity and paternity can be reconciled with working life.”
The challenge, in other words, is structural. But the solutions begin with serious legal thinking — and the political will to act on it.

João Taborda da Gama, sócio da Gama Glória, é um dos especialistas convidados. Especialista em Direito Fiscal e Direito Público, com ampla experiência na interseção entre direito e políticas públicas, o João introduz nuances legais e constitucionais no debate económico em torno deste fenómeno.
“Se acharmos que a causa da fuga de talento é económica,” afirma, “então a única resposta eficaz também terá de ser económica. Não há milagres. Se alguém sai para ganhar mais, não podemos oferecer-lhe uma praia melhor e esperar que fique — teve uma praia a vida inteira, e vai trabalhar para um sítio onde chove mais.”
O João destaca instrumentos fiscais recentes — como o Programa Regressar e o, ainda em evolução, regime do IRS Jovem — como tentativas práticas, embora cautelosas, de alterar a equação económica. “São programas que permitem que o rendimento mediano de jovens qualificados seja mais elevado,” observa. “Parecem-me as medidas certas nesse sentido, embora algo tímidas e com algumas dúvidas jurídicas na sua implementação.”
Uma dessas dúvidas é de natureza constitucional: como justificar benefícios fiscais para alguns contribuintes em detrimento de outros? “Sempre que há uma vantagem fiscal, levanta-se a questão da igualdade,” explica o João. “O juiz constitucional terá de avaliar se essa desigualdade é compensada por outro valor constitucional. No contexto atual, creio que sim. Se a mesma política se prolongasse por 20 ou 30 anos, já me pareceria injustificada.”

Não é apenas por um desconto fiscal que as pessoas saem ou regressam. É preciso perceber se têm casa, se podem ter filhos com dignidade, se conseguem conciliar a maternidade e a paternidade com a vida profissional.”
O desafio, em suma, é estrutural. Mas as soluções começam com pensamento jurídico sério — e com vontade política para agir.
